Understanding the 2024 crypto-asset licensing regime
Since amendments to the Capital Markets Law in 2024, providing crypto-asset services in or targeting Turkey — including operating an exchange, custody or similar platform — generally requires authorization as a licensed crypto-asset service provider (kripto varlık hizmet sağlayıcısı, KVHS) under the Capital Markets Board (SPK). Licensing criteria, capital requirements and the scope of activities that trigger the requirement are set by SPK regulation and can change; whether a specific business model requires a license is a determination for SPK and a licensed capital markets lawyer, not FTurkey. FTurkey can help you understand, at a general level, that this licensing regime exists and identify which questions about your model need a qualified legal opinion before proceeding.
Anti-money-laundering and reporting obligations
Businesses handling crypto-assets in Turkey are generally subject to obligations under anti-money-laundering law, including customer due diligence and reporting to the Financial Crimes Investigation Board (Mali Suçları Araştırma Kurulu, MASAK). FTurkey can help you understand that these obligations exist and coordinate an introduction to a compliance specialist who can design the actual program for your business; FTurkey does not design or implement AML/KYC procedures itself and does not represent that any procedure you adopt will satisfy MASAK.
Company structure and tokenomics: planning questions, not deliverables
Decisions such as where to incorporate a holding entity, whether a Turkish operating company is needed alongside it, and how a token model, treasury and vesting schedule are designed carry legal and tax consequences that benefit from early, coordinated advice. FTurkey can help you organise these questions for a licensed corporate lawyer, mali müşavir and, where relevant, an independent tokenomics or smart-contract specialist, and can coordinate the working relationship between them. FTurkey does not design your tokenomics, audit or write smart contract code, or provide investment or securities advice on any token.
Coordinating your advisory and technical team
Where useful, FTurkey can help identify and brief independent lawyers, auditors, smart-contract developers and compliance consultants suited to your project's stage and jurisdictioanl needs, translate documentation, and keep a shared timeline across these workstreams. Software development, smart-contract audits, fundraising and investor relations are separately scoped engagements — either with FTurkey under a distinct agreement or directly with the specialists involved — and are not included by default.

FTurkey does not obtain an SPK license or any other regulatory authorization on your behalf, does not guarantee that a project will be approved, funded or technically successful, and does not provide legal, tax or investment advice. Ongoing compliance monitoring, exchange listing support and token marketing are outside this service unless separately agreed in writing.
